Raining Code Technologies AG, based in Basel-Stadt, Switzerland, is a software development company. It provides Software-as-a-Service (“SaaS”) products to enterprise customers, and operates Facterra and the website at facterra.ai.
This Privacy Policy describes in detail how your personal data is collected and used. In this policy, “Facterra”, “we” and “us” refer to Raining Code Technologies AG.
Our Privacy Policy applies and respects the protection standards set by the European Union General Data Protection Regulation (“GDPR”), in force since 25 May 2018, which regulates the processing of personal data of natural persons. The provisions of the GDPR apply, on the one hand, within the territory of the EU and, on the other, to all controllers and processors which process personal data of EU citizens. Accordingly, the GDPR also applies to companies not established in the territory of the EU.
Facterra, as a Swiss company, is therefore also subject to the provisions of the GDPR, as well as to the Swiss Federal Act on Data Protection (FADP).
We may also process personal data outside the territory of the European Union. Facterra guarantees that personal data transferred outside the EU is handled by trustworthy vendors.
We limit the processing of personal data to the following purposes, and always upon prior explicit and informed consent:
Occasionally, we may publicly release or share aggregated statistics with our customers. Any such usage statistical information is encrypted, anonymised and aggregated.
If you are a registered user of a Facterra site or service and have supplied your email address, we may occasionally send you an email to communicate the release of new features, solicit your feedback, or keep you up to date with what is going on with Facterra and our products.
We may use the information collected for our own marketing purposes. This includes, but is not limited to, marketing campaigns, marketing events, and newsletters. This information will be used solely for marketing purposes by Facterra and we will not share it with any third parties. Facterra does not resell any personal data to any third party.
If Facterra, or substantially all of its assets, are acquired, user information would be one of the assets transferred to or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of Facterra may continue to use your personal data as set out in this Privacy Policy.
If you send us a request — for example via a support email or one of our feedback mechanisms — we reserve the right to use this information in order to help us clarify or respond to your request, or to help us support other users. Facterra takes all measures reasonably necessary to protect against unauthorised access to, use, alteration, or destruction of personal data.
You may refuse to provide personal data at any time, with the caveat that this may prevent you from engaging in certain website-related activities or limit you from working with the service.
You may correct personal data manually in your account using the account settings in our service. You may always request that we correct or delete your personal data using the contact details below.
Facterra uses third-party sub-processors for hosting services, file storage and backup services, internal company infrastructure, website analytics and performance, customer relationship management, customer ticketing and mail services, and the corporate billing system. Website analytics is provided by Google Ireland Limited (Google Analytics 4), as described under Cookies and other tracking technologies below.
Facterra takes all adequate and necessary precautions to preserve the confidentiality and security of the personal data processed, and to prevent it from being deformed, damaged or destroyed, or from being accessed by unauthorised third parties. However, since Facterra does not control all the risks connected with the functioning of the internet, we draw the attention of internet users to the existence of possible risks inherent in its use and operation.
Data should be kept no longer than is necessary for the purposes for which it is processed. This personal data is strictly reserved for use within Facterra and for internal purposes.
We use technical cookies that are necessary for the functionality and improvement of our sites — to identify visitors, keep preferences, and similar. We do not set cookies for advertisement purposes, and we do not track users across other websites.
We use Google Analytics 4, a web analytics service provided by Google Ireland Limited, to understand how visitors find and use this website — which pages are read, how long visits last, and which sources referred them. Google Analytics sets cookies in your browser and processes your IP address. In Google Analytics 4, IP addresses are anonymised by default and are never stored or logged by Google. We have not enabled Google Signals, advertising features, or remarketing. We do not use the data to build advertising audiences, and we do not sell it.
Where analytics data is transferred to Google servers outside Switzerland or the European Economic Area, that transfer relies on the European Commission's Standard Contractual Clauses and Google's participation in the EU–US and Swiss–US Data Privacy Frameworks. You can opt out of Google Analytics entirely by installing the Google Analytics Opt-out Browser Add-on, or by enabling your browser's “Do Not Track” or tracking-protection setting.
You can always turn cookies off. The help feature on most browsers will tell you how to prevent your browser from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether.
Under the GDPR and Swiss data protection law you have the right to request access to the personal data we hold about you, to have inaccurate data corrected, to have your data erased, to restrict or object to its processing, and to receive your data in a portable form. To exercise any of these rights, contact us using the details below. If you make a request, we have one month to respond to you.
We may update this Privacy Policy from time to time. You can always find the latest version on our site.
